Terms of service

1. What NIWFile is

NIWFile is self-help document preparation software and an information service for EB-2 National Interest Waiver petitions, plus a directory and marketplace through which independent immigration attorneys can offer their services. We are not a law firm. See Not legal advice, which forms part of these terms.

2. Your responsibilities

• Everything you tell us must be true. Misrepresentation on an immigration petition carries severe consequences, including permanent inadmissibility, and it is your signature on the filing.
• You must read every generated document before using it, and correct anything inaccurate. Drafts are proposals in your voice, not statements we make about you.
• You may not ask a recommender to sign a letter containing claims they do not personally believe, and you may not sign on their behalf.
• You must not upload documents you have no right to, or use the service to prepare a petition for someone else while presenting it as your own.

3. Attorneys on the marketplace

This section describes the arrangement precisely, because bar ethics rules constrain it and prospective clients deserve to understand the incentives.

• Attorneys pay us flat fees only. A subscription for platform access, and/or a fixed fee per case lead. Those amounts come from a published rate card and do not vary with the attorney’s fee, the case value, or the outcome.
• We never take a percentage of legal fees, and we never hold them. You pay your attorney directly. Percentage-based arrangements have been held to be impermissible fee-splitting with a non-lawyer under Rule 5.4 by multiple state bars, and we consider them corrupting of the incentive to match you well regardless.
• Nothing is exclusive. Attorneys are free to work with clients from any source, and you are free to hire anyone, including someone you found elsewhere.
• We do not vouch for quality. We verify that an attorney holds an active bar licence in the state they claim. We do not endorse, rank by payment, or guarantee anyone’s work. Self-reported figures such as case counts are labelled as self-reported because we cannot audit them.
• Any engagement is between you and the attorney, governed by their retainer and their professional obligations. We are not a party to it and are not liable for it.

4. Redaction and your identity

If you publish a marketplace listing, we generate a redacted summary intended to remove information identifying you or your employer. We apply both automated pattern removal and review before publication, and you see the redacted version before it goes live. Redaction is best-effort: if your endeavor is itself distinctive, someone determined may still infer who you are. Review your listing before publishing, and do not publish if that risk is unacceptable to you.

5. Fees and cancellation

Subscription prices are shown before purchase and charged in advance. You may cancel at any time and retain access through the period you have paid for. Metered features, such as document generation, are subject to the limits shown on your plan. We do not offer outcome-contingent refunds; see section 7.

6. Acceptable use

Do not attempt to access another user’s case, scrape the case corpus in bulk, resell our output as your own service, submit malicious files, or use the AI features to generate false evidence. Attorneys may not use marketplace data for any purpose other than evaluating whether to offer their services on that case. We terminate accounts for these.

7. Limits of liability

The service is provided as-is. We do not warrant that use of NIWFile will result in an approved petition, that our information is free of error, or that the service will be uninterrupted. To the fullest extent the law allows, our total liability to you is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect or consequential losses, including denial of a petition, loss of status, or filing fees paid to USCIS.

Nothing here limits liability we cannot lawfully limit, including for fraud.

8. Changes

We will post material changes here with a new date and notify account holders by email before they take effect. Continuing to use the service after that constitutes acceptance.
