What an EB-2 NIW actually costs
Government fees, premium processing, and the realistic range for legal help, with the numbers as of September 2026.

Fees change, sometimes with little notice. Verify every figure against the current USCIS fee schedule before you write a check, a filing with the wrong fee gets rejected outright.
Figures below are current as of 10 September 2026.
Government fees
| Item | Fee | Notes |
|---|---|---|
| Form I-140 (Immigrant Petition for Alien Worker) | $715 paper, $665 online | The core petition. It is not the whole government cost; see the next row. |
| Form I-907 (Premium Processing) | $2,965 | Optional. Increased from $2,805 on 1 March 2026. For NIW the guarantee is 45 business days, not the 15 that applies to some other I-140 classifications. |
| Asylum Program Fee | $300 for a self-petitioner | Mandatory on every I-140 since the 2024 fee rule, and the single most commonly omitted number in NIW cost guides. A regular employer pays $600, a nonprofit pays $0, and a small employer or self-petitioner pays $300. It cannot be waived. Filing without it gets the petition rejected, and a rejection is not a denial you can appeal, it is a package returned to you with your priority date unclaimed. |
Later stages, if and when you reach them, adjustment of status (I-485), employment authorisation (I-765), travel document (I-131), carry their own fees, and whether they apply depends on your priority date and whether you adjust status inside the United States or process at a consulate.
Filing online, and the one thing that stops you
Form I-140 can be filed online. But if you are submitting Form I-907 for premium processing at the same time, you must file by mail.
Some widely circulated guides still say USCIS is paper-only for this form. That is out of date. The current edition of Form I-140 is 06/07/24, always download it fresh from USCIS rather than reusing a saved copy, because filing on a superseded edition is a rejection ground.
Is premium processing worth $2,965?
Usually yes, and the strongest argument comes from someone whose case was denied.
Standard I-140 processing has run 18 to 26+ months. Premium processing guarantees a decision in 45 business days, roughly two months.
The value is not mainly speed. It is information. A denial after fourteen months costs you the filing fee and fourteen months of priority date. A denial after two months costs you the filing fee, and you still hold a usable position to refile from. A petitioner in our case database put it directly after a ten-month wait ending in denial:
"File with PP so that if you're denied you don't waste a year's worth of PD."
Premium processing does not speed up your green card. It accelerates only the I-140 decision. It does not move your priority date, and it does not accelerate I-485 or consular processing.
What legal help costs
| Option | Typical range | What you get |
|---|---|---|
| Full representation | $8,000 – $10,000+ | Strategy, petition letter, exhibit assembly, RFE response. Documented in case.md as the quoted range, with 1–3 month preparation. |
| Petition letter only | $2,000 – $5,000 | The legal argument drafted; you assemble evidence. |
| Final review | $500 – $2,000 | An attorney reviews a package you built. |
| Strategy consultation | $150 – $500/hour | One or two hours to settle a specific question. |
| Self-preparation | Government fees only | Documented as viable; also documented as risky. |
Attorney fees are separate from and additional to government fees.
The honest read on self-preparation
Self-petitioning works. case.md documents a cybersecurity manager with no PhD
and no academic publications who was declined by multiple firms, prepared his
own petition in about three weeks, and was approved.
It also fails. A denied petitioner in our corpus, who used a well-known firm under a refund programme, wrote:
"If you have the money, don't cheap out and think that you can do it on your own. There is strong selection bias on all those examples of successful self-petitions, people who fail don't post on Reddit."
Both are true. The selection bias point is correct and important: you are reading a heavily filtered sample, here included.
A reasonable middle path for many people is to prepare the package yourself and buy one or two hours of attorney time on the specific decisions where being wrong is expensive, status timing, concurrent filing, or anything touching prior immigration history. That is a few hundred dollars against a $1,015 filing fee and, more importantly, against your priority date.
Get full representation, not software, if you have any history of immigration violations, unlawful presence, or misrepresentation; if you have received an RFE, NOID, or denial; if your status is expiring or you are out of status; or if your qualification under EB-2 is genuinely uncertain.
Worked example, self-prepared, premium processing
| Form I-140 | $715 |
| Asylum Program Fee (self-petitioner) | $300 |
| Form I-907 premium processing | $2,965 |
| Credential evaluation, if your qualifying degree is foreign | $100 – $400 |
| Certified translations, if needed | varies |
| Courier with tracking | $30 – $80 |
| One hour of attorney consultation | $150 – $500 |
| Total | roughly $4,300 – $5,000 |
Against $8,000–$10,000 for full representation. The gap is real, and so is the risk it buys down. Which side of that trade is right depends on the complexity of your record, not on your confidence.
